First the dowry, then the registration. China's traditional marriage customs are generally the man proposed the betrothal gift, the woman agreed to choose the date of marriage. In modern times, both men and women are engaged first, and then the man gives the bride price, and the two get the license and registration, and then the wedding is held.
There is no clear requirement for this matter, and the customary order is to pass the bride price before obtaining the license registration.
1. For women
For the woman, the first license and then the bride price will be more guaranteed, in case of the certificate, the other party renege on the amount of the bride price, it is more troublesome, and if not yet received the license, the woman can retreat room will be relatively large, so from this perspective, it is recommended that the woman first want the bride price and then get the license, after all, the bride price is not really money, but to express the importance of the woman.
2. For men
For the man, if you really want to marry, then the first dowry and then get a license is nothing, some people will worry that after giving the dowry, the marriage did not succeed, so the dowry is not wasted, if it is because of this problem, then it is completely unnecessary, because our law stipulates the following three situations, the dowry must be returned:
Article 10 of the Supreme People's Court's Interpretation of Several Issues Concerning the Application of the Marriage Law of the People's Republic of China II provides that: Where a party requests the return of the dowry paid in accordance with custom, the People's Court shall support it if the following circumstances are identified:
● Both parties have not registered for marriage.
● Both parties go through the marriage registration procedures but do not live together.
● Pre-marital payment and cause hardship to the payer.
The application of the provisions of paragraph 2 and 3 of the preceding paragraph shall be conditional on the divorce of the two parties, and the provisions of this condition mark that the people's Court has formally made clear provisions on how to deal with the dispute of bride price in the form of judicial interpretation.
So if you give the bride price to the other party first, and the other party does not marry you in the end, then you can get the bride price back through legal means, since this worry has been solved, then why not give your girlfriend a peace of mind protection?
